Article 7 of the UNCITRAL Model Law on Electronic Commerce further confirms that electronic signatures are recognised.[8] The United States adopted the UNCITRAL Model Law by the adoption of the Uniform Electronic Transactions Act[9] and the Electronic Signatures in Global and National Commerce Act.[10] The EU also adopted the UNCITRAL Model Law in two stages. The first stage was the adoption of the Directive on Electronic Signatures.[11] The second stage was the adoption of the Ecommerce Directive.[12]. The question of validity of an e lectronic signature will come to the fore once proof of the signature is required.[13] United States The European Commission The European Union is a market with a diverse membership, each with its own domestic legislation. To ensure uniformity in some matters the EC adopts Directives that the member states are required to implement into their domestic legislation. It is further intended to provide legal certainty to participants in the EU.[16] The concept of the internal market is the creation of an area without any internal borders to ensure the free moveme nt of goods, services and freedom of establishment between the members.[17] The Directive is therefore aimed at ensuring that new member states as well as existing members implement and apply the legal framework for electronic commerce. According to the EC, the cornerstone of the Directive is the legal certainty and the clarity that the internal market clause of the Directive provides.[18] The Directive ensures that persons who enter into online contracts within the EU will have certainty as to the legal consequences of the contract and will further create an environment of trust between citizens of different members. This will again indirectly ensure the growth of online commerce and contribute to the wealth of the member states. If the certainty did not exist, consumers will be exposed to risks which may a negative consequence on the economy.[19] There is legislation that contains consumer protection and also that documents be in writing and the Directive that such contracts are valid if they are made through the internet. All businesses creating a CSR must choose the best way to meet the needs of the present without infringing upon the ability of future generations ability to meet the same needs in the future. A company’s CSR will show the public the results of choices made during the year, which pressures executive decision makers, to weigh these decisions carefully since they will be held accountable. This also applies to maintaining the business so that the business continues and provides for future generations of employees as well as for stockholders. Just as marketing campaigns measure positive improvements in business through sales, so can CSR and sustainability efforts be measured in many ways. There are also defined practices for how to measure the results of social efforts, environment efforts, and of course financial efforts, thus the three P’s again; profit, people and planet. (Sprinkles Maines, p. 448-451) The possibility of leaving the environment, generation after generation, with less species in the ecosystem is not something that is obvious to executive management, but poses a risk for the future ecosystem and therefore to the human race. For example, a species that is almost undetectable may seem relatively unimportant, but the complete absence of this species could in fact change the environment forever by permanently changing the ecosystem. No one knows if this will leave the ecosystem unaffected, or severely and irreparably damaged until the actual occurrence. Unfortunately, the change in the environment is the first warning that scientists receive to study how the ecology is interdependent and learn what is changing in the ecosystem. Business decisions must rely on superior knowledge to make the best decisions, to avoid a public relations nightmare and to perform this responsibly in their role. If corporations have the power to alter the ecosystem, they become stewards of the environment. â€Å"In 1970, Milton Friedman, a Nobel prize-winning economist, expressed his viewpoint that the social responsibility of business is to increase its profits.† (Sprinkle Mains, p.445) The opposite of this sentiment, that businesses are completely responsible for any damage they cause to the environment, is a contrasting opinion becoming popular in the early part of the twenty-first century. â€Å"Corporate sustainability focuses on increasing shareholder value by incorporating principles in nine areas: ethics, governance, transparency, business relationships, financial return, community involvement, product value, employment practices and environmental protection.† (Sprinkles Maines, p.446) CSR activities to be included are corporate donations of cash or products, allowance for employee time off (for volunteering), activities relating to employee health and welfare, improving the environmental profile of the products produced, the humane treatment of animals, and the eradication of product testing on animals. Also included is the incorporation of â€Å"green† production practices into the current business by acquiring a green business, architecting one from scratch or accentuating current practices that are green in nature already. (Unruh Ettenson, p. 96-98) Other activities affecting the CSR are the production and the whole value chain which should be reviewed for conserving energy, reducing emissions, using recycled materials, reducing packaging materials, and sourcing materials from vendors located geographically close to manufacturing facilities. (Sprinkles Maines, p.447) Manufacturing must include analysis of the environmental impact of the products entire lifecycle from development to disposal. Companies also should look into their value chain to calculate improvements for reducing transportation, energy waste, duplication of efforts, etc. For those companies who build, they should invest in becoming ‘leadership in energy and environmental design† (LEED) certified which aims at strategies to improve performance across all metrics. Attributions determine if the public is going to react positively to the company’s CSR efforts. Engagements must be aligned with the corporation as the customers must be able to reason why the company is involved in the activity in order for it to appear sincere. (Bhattacharya Sen, p. 14) Attachment is created internally by consumers when the identification to the cause and the company is powerful and taps into their needs for self–definition and social identity. (Bhattacharya Sen, p. 15) â€Å"Cause-related marketing is the process of†¦marketing activities that are characterized by an offer†¦.to a designated cause when customers engage in revenue providing exchanges that satisfy organizational and individual objectives. (Varadarajan Menon, 1988, as cited in Berglind Nakata, p.444) The benefits of cause related marketing (CRM) go hand-in-hand with CSR initiatives; assisting a nonprofit will also have the desired effect of increasing customer lifetime value (CLTV) as well as improve brand recognition with brand building for new customers. An example of this is the results that American Express calculated of an increase in card use of up by 28% when it sponsored the Statue of Liberty Campaign. (Berglind Nakata, p.447) If the CSR initiative helps a noteworthy cause, and the cost involved is not greater than the calculated spend for total customer cost it will be a worthwhile cost. Other benefits include improving the corporate reputation, generating more r evenues, goodwill, and enhancing employee morale and retention. Also the CRM increases funding of nonprofit organizations (NPOs), heightens NPOs exposure and message efficacy. It also provides much needed non-financial resources to the NPOs. (Berglind Nakata, p.447-8) Just as there are unlimited activities to participate in CSR there are also many different reasons why companies participate in CSR. Because of altruism, to appease various stakeholders groups such as nongovernmental organizations (NGOs), focusing on environmental concerns could lower the cost of production, easing legal or regulatory constraints. (Sprinkles Maines, p.448) The costs associated with CSR can be measured by identifying the activities chosen by the company that are intended for CSR purposes, the estimated cost of activities the company refrained from doing due to the involvement with CSR, and the estimated revenue that would have been derived from company activities. Another factor is the company must consider the opportunity cost of doing not performing another charitable or different activity and estimate what exposure are they losing from that activity. Measuring the cost inflows or outflows, tax credits, sales tax exemptions, property tax abatements, free advertisi ng, as CSR attracts, motivates and retains talent, turnover is reduced and can be estimated. â€Å"Firms can translate increased retention rates†¦ to the costs of employee turnover.† (Sprinkles Maine, p.450) The United Nations’ developed seventeen Sustainable Development Goals to achieve by 2030 that is considered a blueprint for a better tomorrow. This comprehensive list is referenced by companies in their own CSR to ensure they are not overlooking the recognized goals to achieve and must look into their own value chain to achieve these goals if possible. Of the 17 issues some are the eradication of poverty and hunger, making vaccinations available, cleaning the ocean and social issues such as gender equality, and reduced inequalities among people. All companies should be doing CSR work, not only to perform charity, but to compete, since it is expected by the public. Companies shrewdly foster brand development and awareness to improve customer loyalty and customer lifetime value with CSR initiatives. Companies should want to create an employer brand as well to turn their employees into brand ambassadors. â€Å"A strong employer brand attracts and retains workers and turns them into advocates for the company. It differentiates their organization from the next.† (Gallup, p.23) The Gallup Study introduces the idea of allowing remote workers to contribute to savings which are financial but also a benefit to the environment with an unexpected tradeoff of, increased employee engagement. Employees save on transportation costs, lunch costs, and business attire and laundering while employers save on energy (heat or air conditioning), electricity, and space savings on the workspace. The savings for the city is on congestion from employees traveling to and from the city either in personal vehicles or on the city buses or trains. Fewer people translates to less traffic congestion. Under Obama’s leadership, the Federal Government allowed employees who weren’t executive leadership to work remotely at least one day a week, in an effort to reduce emissions and reduce the agency’s carbon footprint. This was very progressive when the Federal Government acknowledged that people are happier, more fulfilled and productive when given a flexible work sched ule and allowed to telecommute regularly. According to the 2017, State of the American Workplace Study, by Gallup, 37% of employees would switch to a job that gives the kind of flexibility that remote working affords. The study found that working remotely positively influences employee engagement and employee engagement climbs when employees are able to work remotely and also come into work to a home base part of the time. Surprisingly, the optimal gain was when employees were remote 60-80% of the time. (Gallup, p.153) Another surprising fact is â€Å"fully remote workers are 17% more likely than employees who work in the office 100% of the time to strongly agree they have a clear job description. (Gallup, p.157) These findings should change the view of the office and employment of the future. People should be given a chance to work remotely to see if productivity increases as the Gallup Study suggests; this is what companies need to survive and thrive in the future.

The film Thirteen portrays the chaotic lives of two thirteen year olds, Tracy and Evie. In the beginning of the movie, Tracy was an overall good daughter, friend, and student, until Evie stepped into the picture and turned her good habits into detrimental ones. The two girls became an unstoppable duo and caused a disorderly impact on those around them. From disrespecting her own mother and mother’s boyfriend every day to robbing money off of her mother’s clients and strangers at the mall, Tracy’s behavior became identical to Evie’s. The Department has produced the guidance for policy in accompanying documents to the Act and the Regulations which are known as the PAM3 (Procedure Advice Manual) and the MSIs (Migration Series Instructions)[2]. The visa under subclass 600 is granted to such applicants, who apply for a Business Visitor steam visa. Such applicants have to fulfill the primary criteria stated in Subdivisions 600.21 and 600.24[3]. In this case, the Class FA Visitor (Subclass 600) was granted with certain conditions[4]. These conditions were, 8101, which states that the holder of such visa should not engage in work in Australia. The condition stated in 8201 contains, that the holder of such visa should not be engaged in any sort of training or studies for more than a period of 3 months, after entering Australia. The conditions stated in 8503 states that once the holder enters the country, such holder would not be entitled to a grant of any substantive visa, till the time such holder is in Australia. This condition is not applicable for a protection visa. Lastly, the 8531 condition prohibits a holder of such visa from staying in Australia, after the end of the permitted period of stay. The regulation 1.03 of the Migration Act, 1958[5], defines work as an activity which normally attracts remuneration in Australia. As per the Section 116 of this Act, the Minister has the power to cancel a visa if the Minister is satisfied that the holder of visa has failed to comply with the conditions of the visa[6], among the other provisions. Section 245AG of the Migration Act, 1958[7], contains the provisions regarding the meaning of work and allows to work. As per subsection 1 of this section[8], work means any sort of work whether it is done for a reward or otherwise. Further, the subsection 2[9] provides that, a person allows other person to work, only if one person employs or engages the other person, as per a contract of service, other than in a domestic context. In the case of Amandeep v Minister for Immigration Anor[10], the Court relied on the definition of work given in Regulation 1.03. The Court also relied on the test regarding the activity which is performed by an individual and whether such activity normally attracts remuneration, in the country (Australia). The Court also relied on the context of assistance which was provided in terms of social, commercial, altruistic motivations or domestic. The Court held that the applicant was indeed working and hence, the application was dismissed with costs. Application In the present case, the work which Walter wants to undertake for his cousin is commercial in nature. As per the conditions of his visa, 8101, he is prohibited from engaging in work in Australia. Further, as per the definition of work given in the Regulation 1.03, as well as the interpretation of the Court in the case of Amandeep v Minister for Immigration Anor, the activity proposed to be undertaken by Walter is covered under work as such work attracts remuneration in Australia. Also, his cousin wants to employ Walter as a contractor, which clearly infers the activity as work. So, it is advisable to Walter, to not engage in the activity of building a deck and landscaping for his cousin, as this would be considered as work and his Visa may get cancelled, as a result of engaging in such activity. Conclusion So, it can be concluded that Walter should refrain from providing the services to his cousin, Jesse Pink; otherwise his visa may be cancelled by the Minister for a failure to comply with the conditions, while grant of the Class FA Visitor (Subclass 600) visa. The Trail of Tears, was it unjust and inhumane? What happened to the Cherokee during that long and treacherous journey? They were brave and listened to the government, but they recieved unproductive land and lost their tribal land. The white settlers were already emigrating to the Union, or America. The East coast was burdened with new settlers and becoming vastly populated. President Andrew Jackson and the government had to find a way to move people to the West to make room. President Andrew Jackson passed the Indian Removal Policy in the year 1830. The Indian Removal Policy which called for the removal of Native Americans from the Tennessee, North Carolina, South Carolina, and Georgia area, also moved their capital Echota in Tennessee to the new capital call New Echota, Georgia and then eventually to the Indian Territory. The Indian Territory was declared in the Act of Congress in 1830 with the Indian Removal Policy. Elias Boudinot, Major Ridge, and John Ridge and there corps accep ted the responsibility for the removal of one of the largest tribes in the Southeast that were the earliest to adapt to European ways. There was a war involving the Cherokee and the Chickasaw before the Indian Removal Policy was passed. The Cherokee were defeated by them which caused Chief Dragging Canoe to sign a treaty in 1777 to split up their tribe and have the portion of the tribe in Chattanooga, Tennessee called the Chickamauga. Chief Doublehead of the Chickamauga, a branch of the Cherokee, signed a treaty to give away their lands. Tribal law says "Death to any Cherokee who proposed to sell or exchange tribal land." Chief Doublehead was later executed by Major Ridge. Again there was another treaty signed in December 29, 1835 which is called The Treaty of New Echota. It was signed by a party of 500 Cherokee out of about 17,000. Between 1785 and 1902 twenty-five treaties were signed with white men to give up their tribal lands. The Cherokee would find themselves in a nightmare for the next year. In 1838 General Winfield Scott got tired of delaying this longer than the 2 years he waited already so he took charge in collecting the Cherokee. The Cherokee were taken from their homes and their belongings. The were placed in holding camps so none would escape. The Cherokee were to be moved in the fall of 1838. The journey did not occur in October, 1838 because of bad weather. They were now supposed to move 13,000 Cherokee in the spring of 1839 a distance of eight-hundred miles. The Cherokee were fed on meager rations and suffered malnutrition. They were badly clothed for the spring and many caught diseases and died. Many Cherokee tried to escape and some succeeded. The Cherokee knew these woodlands and knew where to go. The white men couldn't find them without the help of other Cherokee and bribes. Most of the Cherokee hid in the mountains and could not be found. During the eight-hundred mile trek many children and spouses were separated from their families whe n the Government would split up the Cherokee into groups of 1,000 for ease of removal. About one-third of the original Cherokee they collected died in the holding camps and between the trek from the Southeast section of the Union to Indian Territory. They would have to learn a new way of life and adjust. They lost their negro slaves, and their possessions. The Cherokee were farmers, and the land was infertile. The land was meant for cattle raising, which they didn't know ho to do. They built a capital city called Tahlequah, and their nation was declared in September 6, 1839. Their culture was bred here along their new way of life. John Ross who was elected by the Cherokee as the President of the Cherokee nation in 1827 continues his roll in the land, shared with another seventy tribes. They had opened up schools in the Indian Territory to continue their education for their children. The first Cherokee school opened in 1801 when the people were learning their language. Systems of organization and control based on three principles: hierarchical authority, job specialization, and formalized rules. Sure there are the ones we know and think as being bureaucracies such as the government and the education system, but many people do not realize the organizations they belong to and the activities they do for fun are still bureaucracies. Such is the case with a baseball team. A baseball team has all the fundamentals of a bureaucracy. There is the hierarchical authority in the order of the head coach who has all of the power to direct and control the team. Everybody else involved with the team has to answer to the head coach. The head coach makes the policy, as Patterson would say. He appoints the assistant coaches and chooses which players to have on the team. The assistant coaches would come next in line. They have control over the players also but they have to answer to the head coach about what to teach. The assistants also play a role in choosing which players should be on the team, but ultimately the head coach makes the choice. The bottom of the hierarchical authority line is the player who must obey both the head coach and the assistant coaches. The job specialization is apparent on a baseball team. The players know their job is to play the game the way the coaches want them to. They are each specialized in the position they play on the field. The coaches teach them how play the way they want them to play. The assistant coaches have to be specialized in a certain area. (Ex.: outfield, infield, pitching, etc...) while all of this is going on the head coach has to decide how to teach and play the game as a whole. My final argument will be based on the effectiveness of this tax: The tax will have no significant impact on greenhouse gas emissions. It has been claimed that an Australian carbon tax will have no significant impact on the level of greenhouse gases in the earths atmosphere. This claim has been made on two bases. Firstly that it is unlikely to succeed in significantly reducing Australian greenhouse gas emissions and secondly, that even if these emissions were to stop completely this would have no useful effect on world greenhouse gas emission rates. Critics of a carbon tax for Australia argue that it will damage our economy without reducing climate change. The independent think tank, the Institute of Public Affairs (IPA) has stated that the proposed tax, although burdensome and damaging is not sufficiently large to force reinvestment in different forms of power generation. In a media released issued on March 2, 2011 and published in The Age, the IPA stated, The price itself, while severely harming the carbon-intensive, coal-based generators, would not force their premature departure from supply, which would be necessary to leave a gap for new gas generators. The IPA Review in September 2008 included the following response to Kevin Rudds proposed emissions trading scheme, Australia contributes 1. 1 per cent of total global greenhouse gas emissions. Our contribution is dwarfed by big emitters like the United States which contributes nearly 21 per cent, China which contributes 17 per cent, and Russia which contributes just over 5 per cent. All in all, there is no positive outcome for this tax, yes it is true that it reduces greenhouse gases, but things cannot always be solved with money. If we, as the Australian people want to make our environment cleaner, we should not just pay up to the government to clean our environment, we live in it, so we must put in some effort to prevent this ongoing issue. Postmodernism and Christianity - Essay Example Thesis Postmodernism odds with religion as it unveils realities of life, it is ironic and playful in contrast to dogmatic and strict religious rules. Postmodernism is defined as an artistic style emerged in opposition to "modern" traditions: it is more ornamental and ironic. There is no such notion as truth. Postmodernist thought, in attacking the idea of a notional centre or dominant ideology, facilitated the promotion of a politics of difference. Under postmodern conditions, the ordered class politics preferred by socialists has given way to a far more diffuse and pluralistic identity politics, which often involves the self-conscious assertion of a marginalized identity against the dominant discourse (Connor 40). Much feminist thought therefore has in common with postmodernism that it attacks the legitimating metadiscourse used by males, designed to keep them in power, and it seeks an individual empowerment against this. This is the key to creativity in the individual. This evidence for the growth of an individual through the socialization process is neglected by 'social construction' theorists of the self (Bataille and Hurley 88). The cultural context of the father figure is lively and confused. The father and Jesus is the source of all morals and religion; every human being must work through his or her relationship to the father on the way to maturity. Religion and morals are merely ways in which the repressed memory of this deed finds expression. Thus the dead and repressed father, whose figure each one of us internalizes and thereby makes into a source of authority, is more powerful than the living one. However, the father may not be as central to our psychic life. He regards the vanishing of the father as the outcome of a long process, which can be traced in art and literature (Connor 39). Photography vs. Text Man's first step on the moon, the Hindenburg Disaster, The Gold Rush of 1849, The Great Depression, and the realities of Vietnam are all in our memory because of one thing: photography. Many may not remember what literature and history books say about the war in Vietnam, but what about the graphic photo of a South Vietnamese Buddhist burning himself alive? Some may not recall the words of news anchor Walter Cronkite as he announced the death of President Kennedy, but may reminisce on what film captured-- first he took off his glasses, next he looked you straight in the eyes and delivered the message in a straightforward and serious matter: "Three shots were fired at President Kennedy's motorcade in downtown Dallas." (qtd. in Bestor) Cronkite remembers it as "the only time (he) ever broke down while on the air." (qtd. in Hayes) An hour and a-half later, According to the World Book Multimedia Encyclopedia, photography froze history as Lyndon B. Johnson made his presidential oath on Air-Force One. Jackie Kennedy watched on with ineffable emotion. ("Kennedy"). Two days later was the assassination of Lee Harvey Oswald, captured by a photographer at the exact moment that Jack Ruby pulled the pistol and shot Oswald point-blank. The picture-- depicting the horror on Oswald's face and Jack Ruby's expression of anger-- won the 1963 Pulitzer Prize for photographic journalism. Edward Steichen said to TIME reporters in 1961 that "photography records the gamut of feelings written on the human face, the beauty of the earth and skies that man has inherited, and the wealth and confusion man has created.
